The Maryland Automobile Insurance Fund (MAIF) provides insurance to those who cannot get insurance elsewhere. Most MAIF policies are $20,000 per person with a maximum of $40,000 coverage for the entire accident. These amounts will now change since the minimal limit in Maryland is being raised to $30,000 per person with a maximum of $60,000 coverage for the entire accident.
Over the last several years, it has become increasingly difficult to get MAIF adjusters to make a fair offer. In fact, Portner & Shure retains a list of MAIF adjusters who are notoriously unfair. When the name of one of these adjusters appears on a file, we advise our clients to file a lawsuit rather than negotiate.
MAIF has a predictable a corporate strategy. First, the carrier can take a tougher stance because MAIF's liablity exposure is, in most cases, just $20,000, whereas other carriers exposure is often $100,000. This approach may change since the minimal limits have been increased. Second, like GEICO, MAIF believes that, if it takes a tough or unreasonable negotiating position, it will dissuade attorneys from taking many of these cases. While this attitude may deter some firms, it has not changed the manner in which the Maryland auto accident lawyers and Virginia car accident attorneys at Portner & Shure screen cases.
